Dream team brings extensive track record of winning on appeal to construction defect law firm

Their work has led to several published opinions including such landmark decisions as Seahaus v. Superior Court (2014) 224 Cal.App.4th 754, Treo@Kettner Homeowners Assn. v. Superior Court (2008) 166 Cal.App.4th 1055, and Shirk v. United States (9th Cir. 2014) 773 F.3d 999.

Leading the team is partner Anne Rauch, a certified appellate specialist by the California Board of Legal Specialization for the State Bar. Her work on appeals and writs has resulted in wins in a broad range of practice areas including construction defect claims, real property litigation, business and partnership disputes, contract claims, insurance coverage, corporate governance and breach of fiduciary duty claims, and anti-SLAPP motions and appeals. Rauch offers vast expertise in all aspects of common interest development law and multi-million-dollar construction defect claims for community associations from inception and the initial defect investigation through settlement, trial, and to successful conclusion on appeal.

Well-rounded with experience in both trial and appellate courts the team will handle all aspects of civil writs and appeals while providing important strategic advice to trial attorneys on how to win at trial to keep the victory on appeal. Internally, in addition to handling most BerdingWeil appeals, they will handle and guide dispositive motions and the trial and post-trial motion process, greatly improving chances of success in the ensuing appeal if necessary. The BerdingWeil appellate team is also happy to collaborate with attorneys outside the firm, by either associating in as co-counsel on appeal to take the lead (alleviating any stress busy trial attorneys have when their cases go up on appeal) or providing invaluable consultation services from behind the scenes.
